Agreement on the procedure for ordering, selling, and delivering goods

Chapter 1. Terms used in this agreement.

1.1. In this Agreement, the terms listed below have the following meanings and are an integral part of it:

"Bazarstore" LLC – "Bazarstore" LLC, whose details are provided in the "Details" section of the Agreement.

"Website" – https://bazarstore.az

"Online-store" – a service intended for ordering goods in Bazarstore LLC markets via the Internet, located at https://bazarstore.az.

"Rules" – rules that define the confirmation, guidance, cancellation, and other operations necessary for acquiring goods in the online store located at https://bazarstore.az.

"Order" – the selection of goods in the online store and the confirmation of its submission by the method specified in the rules.

"Buyer" – a person intending to purchase goods through the online store.

"Law on Personal Data" – the Law of the Republic of Azerbaijan on Personal Data.

"Personal Data" – personal data provided by the buyer to Bazarstore LLC in the manner prescribed by the Law on Personal Data for the purpose of fulfilling the order. Personal data refers to name, surname, patronymic, date of birth, email address, and contact phone number.

"Communication Channel" – methods of informing the buyer about the fulfillment of the order, which are listed and selectable in the online store.

"Goods" – products available in the online store that the buyer can purchase.

"Separate groups of goods" – products of Bazarstore LLC's own production – confectionery, fruit and vegetable products, fish products, and other goods with a shelf life of 36 hours or less.

"Maximum Order Completion Time" – the selected time within the established limit by which the order will be reliably ready and presented for pickup by the buyer.

"Goods of improper quality" – goods unsuitable for their intended use, defective goods, goods with deficiencies (deficiency – violation of mandatory requirements for the product) or goods that do not match the description on the website, expired goods, goods delivered to the buyer in damaged packaging.

Chapter 2. General Provisions

2.1. The Agreement is an official offer from Bazarstore LLC to any individual with legal capacity to enter into an agreement for the sale and purchase of goods on the terms specified in the agreement, and it contains all essential terms of the agreement.

2.2. Acceptance of the terms of the Agreement is mandatory to be able to place an order in the online store. The Buyer cannot place an order without accepting the terms of the Agreement and the terms of other agreements required for order fulfillment.

2.3. The Agreement between the Buyer and Bazarstore LLC is considered concluded from the moment the order is placed and confirmed.

Chapter 3. Registration on the Website

3.1. Only registered buyers can place orders in the online store.

3.2. Bazarstore LLC is not responsible for the accuracy and correctness of the information provided by the Buyer during registration.

3.3. The Buyer who registers in the online store obtains individual identification by providing a username and password. The Buyer's individual identification allows preventing illegal actions of third parties on behalf of the Buyer and provides access to additional services.

3.4. The Buyer independently bears responsibility for all possible negative consequences in case of transferring the username and password to third parties.

Chapter 4. Placing an order and terms of purchase of goods

4.1. After receiving an order, the online store informs the Buyer about the receipt of the order and the possibility of its execution through the communication channel preferred by the Buyer.

4.2. The Buyer agrees that the following parameters may be changed at the initiative of Bazarstore LLC: the list of ordered goods, the preparation time of the order.

4.3. The weight/quantity of goods available for order may be limited.

4.4. If the desired Goods are not available at Bazarstore LLC at the time of placing the order, the Buyer is offered the option of agreeing on substitutes. At the time of order fulfillment, a substitute Good from the same price range will be offered.

4.5. The Buyer can cancel the order at any time. The online store can notify about the order cancellation through any method provided for in the communication channel.

4.6. The Buyer agrees that when ordering separate groups of goods, their average weight is indicated, while the permissible error in their actual weight relative to the average weight is up to 9% and up to 20% for some goods. Payment for goods sold by weight will be made according to the actual weight.

4.7. The ownership of the goods passes to the Buyer from the moment of payment for the goods.

4.8. The Buyer agrees that at the time of preparation and completion of the order, some goods may not be available for sale, and in such cases, if the Buyer's order contains unavailable goods, the Buyer will be notified in advance through the communication channel preferred by them.

4.9. The Buyer agrees that the appearance of the Goods may differ from their image in the online store.

4.10. The Buyer's order is considered fulfilled from the moment Bazarstore LLC issues a cash or sales receipt or another document confirming the payment for the goods at the point of delivery to the buyer.

Chapter 5. Terms of goods delivery

5.1. The minimum purchase amount is 40 AZN.

5.2. The service for delivering purchased goods is free. (Minimum purchase amount is 40 AZN.)

5.3. Orders are delivered to the following districts:

Narimanov, Nasimi, Nizami, Sabail, Khatai, Yasamal, Binagadi district (Microdistricts), Khazar, Surakhany, Sabunchu

Chapter 6. Payment for Goods

At the time of creating or receiving the order, the Buyer can pay for the purchased goods using any of the following convenient methods:

6.1. Payment upon receipt of the order.

Card payment: Payment is made only after checking your order (not exceeding 15 minutes), familiarizing yourself with the goods, and deciding on the purchase. The employee of Bazarstore LLC online store provides a cash receipt.

Cash payment: Payment is made only after checking your order (not exceeding 15 minutes), familiarizing yourself with the goods, and deciding on the purchase. The money is handed to the employee of "Bazarstore" LLC online store.

6.2. The Buyer agrees that the price indicated in the online store for separate groups of goods (sold by weight and individually) is an approximate price due to the permissible error in actual weight.

6.3. The Buyer agrees that the price of the product displayed on the website at the time of order confirmation is considered final and unchangeable for that specific order. Any increase or decrease in product price after order confirmation does not apply to already confirmed orders and does not create additional obligations between the parties.

Chapter 7. Return of Goods

7.1. With the exception of ordered cold chain food products, other non-food and food products can be exchanged or returned within 14 (fourteen) calendar days from the date of purchase, provided that the product has not been used and its packaging is intact and undamaged, at the relevant market indicated on the receipt. (For product exchange or return, the customer is required to present the product and the purchase receipt to the market.)

Chapter 8. Confidentiality of information, protection of personal data

8.1. Bazarstore LLC guarantees that personal data will be used in accordance with the Law on Personal Data, ensuring its proper protection and compliance with the requirements of the Law on Personal Data.

8.2. The Buyer confirms that the personal data provided by him is correct and sufficient for the fulfillment of the order. If the Buyer fails to comply with this clause, Bazarstore LLC is not responsible for the incorrect fulfillment of the order.

8.3. The Buyer, in accordance with the requirements of the Law on Personal Data, by accepting the agreement, consciously, informed, freely, acting on his own will and in his interest, gives his consent to the processing of his personal data for the purpose of fulfilling the order and for other purposes specified in the agreement.

8.4. Processing of personal data refers to the collection, systematization, accumulation, storage, clarification (updating, modification), use (including transfer), blocking, destruction of personal data.

8.5. Bazarstore LLC has the right to transfer personal data to third parties in the following cases, and the buyer allows this:

• when there is a legal request from authorized bodies;
• when the fulfillment of the order is impossible without the transfer of personal data to third parties.

8.6. With the exception of the cases mentioned in this chapter, Bazarstore LLC guarantees that personal data, as well as other information provided by the buyer, will never and under no circumstances be transferred to third parties.

8.7. Bazarstore LLC guarantees the presence of organizational and technical measures to protect personal data and other information provided by the Buyer from illegal or accidental access, their destruction, modification, blocking, copying, distribution, and other illegal actions.

Chapter 9. Force Majeure

9.1. Either party is released from liability for full or partial non-fulfillment of obligations under the Agreement if the reason is force majeure circumstances that occurred after the parties signed it.

9.2. Force majeure refers to extraordinary events or circumstances that a party could not foresee or prevent with available means. Such extraordinary events or circumstances include, but are not limited to: strikes, floods, fires, earthquakes and other natural disasters, war, military operations, actions of local or foreign government bodies, as well as any other circumstances beyond the reasonable control of either party.

9.3. Changes in legislation or normative acts directly or indirectly affecting either party are not considered force majeure, but if such changes are made that do not allow either party to fulfill its obligations under this Agreement, the Parties must immediately make a decision on the procedure for resolving this problem to ensure the continued execution of the Agreement.

Chapter 10. Final Provisions

10.1. Bazarstore LLC has the right to change the prices of Goods in the online store without notifying the Buyer.

10.2. Changes to the Agreement will be considered valid after they are published in the online store and confirmed by the Buyer at the time of placing the order, and will apply to agreements concluded after the date of publication.

10.3. The Parties will endeavor to resolve all disputes related to the non-fulfillment or improper fulfillment of their obligations under this Agreement through negotiations.

10.4. If no agreement is reached during negotiations, disputes will be resolved in court in accordance with the legislation of the Republic of Azerbaijan.

11.1. Suggestions and complaints can be sent via the feedback form on the official website of the online store and Bazarstore LLC at http://www.bazarstore.az/elaqe, or by calling (+994 12) 404 19 70 / 71 / 72 / 73 / 74 / 75 and (+994 55) 201 35 35 daily from 09:00 to 18:00.
